Ariha has no one in Germany. In India, she can develop bonds with her extended family and culture while her parents fight their case in Germany, which will take 3+ years. If the parents win, it will be easier for the baby to re-integrate with them. If they lose, she will not have lost ties to her wider family and heritage.
The German Child Services plan to adopt Ariha to a German family if she remains there.
Ariha, though Jain, is being threatened with a meat diet and refused any interaction with the local Indian community.
German Child Services are violating the Ariha's cultural and religious identity.

We suspect that the German agencies want to take advantage of the "continuity principle" of child law. If a child has spent significant time with state-appointed foster care, they would never be returned to their parents, even if the parents are found fit by the court.
