Injustice in the Verdict:
Unmasking the Unfairness in Ariha Shah's Case
No Fair Trial: A skewed courtroom saga, where the parents' defence was overlooked, and judgment was drawn solely based on the injury, disregarding crucial evidence.
Inconsistencies in Medical Assessments: The court turned a blind eye to hospital misdiagnoses and conflicting German doctors' statements, unjustly disregarding parents' explanations and evidence, thus compromising the trial's fairness.
Disregard for Medical Expert Reports: An alarming bias in court, favoring initial German assessments over comprehensive international medical reports, confirmed the accidental nature of Ariha's injury but were conveniently overlooked.
Ignored Expert Opinion: In a startling dismissal of justice, vital expert evaluations - from gynecologists to linguistic and cultural studies specialists - were disregarded in court, debilitating the parents' defense.
Ignored their own court appointed Expert's Recommendations: A shocking oversight by the judge, neglecting the court-appointed psychologist's advice to prioritize Ariha's welfare with a parent-child facility, reflecting a failure in prioritizing the child's well-being
Exaggerated Claims: The court's misleading portrayal of Ariha's minor, unrelated head injury, promptly addressed by professionals, magnified to strengthen the German Child Service case, indicates an alarming level of bias.
Explaining the Discrepancies and Injustices in the Recent Court Verdict - Seeking Justice for Our daughter Ariha Shah
Explanation about the Injury: In a dismissive turn, the court overlooked the parents' detailed account of the accident, and expert reports indicating the grandmother's unintentional role, favoring a narrative that ignored clear indications of an accidental injury
False Claims and Disregard for Medical Documentation: A concerning disregard by the court for documented pediatric consultations, falsely attributing a skin allergy to parental harm, and overlooking ongoing similar occurrences in foster care.
Court's Failure to Address German Child Service's Mistakes: A shocking oversight by the court, ignoring Ariha's cultural rights violations in German foster care, including hindrance to learn her language, engage with her culture, or interact with the Indian community in Berlin.

WHY WE SEEK IMMEDIATE REPATRIATION TO INDIA?
Ariha, born to a Jain family, is supposed to practice Ahimsa, which is her right according to the rights for the child, and even German constitution permit this which is not been followed. In Jainism the food being a critical aspect. Instead, she's being fed eggs and non-vegetarian food, such as sushi, which is against her religious beliefs.
Ariha is not taught anything about the Jain religion. Which are her rights according to the rights for the child, and even German constitution permit this which is not been followed. She even doesn’t know about our revered Tirthankar Mahavir Swami.
Ariha is not allowed to learn her mother tongue Gujarati, Indian national language Hindi or universally spoken language English. Serious act of making a child German.
German Child Services are violating the Ariha's cultural and religious identity.
Ariha is not allowed to visit temples, play with Indian children or participate in Indian festivals and events.
It is evident that Ariha desires to be with her parents. The pain and distress she experiences at the end of each visitation are palpable, yet she is forcefully separated from them.
